Commercial auto insurance requirements by state

Every state requires commercial auto coverage, but what you need depends on where you live. Common insurance types include:

  • Liability: Commercial drivers always need liability insurance, though the minimum amount varies from state to state. This coverage helps if you injure someone else or damage their property.
  • Uninsured/underinsured (UM/UIM) motorist: Many states require UM/UIM coverage, which pays for injuries to you or your passengers if the at-fault driver doesn't have enough insurance to cover the damages.
  • Medical payments (MedPay): MedPay is a driver protection that covers medical expenses for you and your passengers, regardless of who caused the accident.
  • Personal injury protection (PIP): PIP coverage is required in most states with no-fault insurance laws. It covers things like medical bills, lost wages, and important services like childcare while you and your passengers recover.

State laws don't call for collision insurance or comprehensive coverage, but it's good to consider them. They protect business autos from accidents and other events, like fire or theft. If you finance or lease your vehicle, your contract might require these coverages, even if the government doesn't.

State minimum coverage limits

States also decide how much insurance you need. The coverage amount, or insurance limit, is the maximum payment for a liability claim. Most states use split limits, which consider three things:

  • Bodily injury per person
  • Bodily injury per accident
  • Property damage per accident

For example, North Carolina law says the minimum split limit on a commercial auto policy is 30/60/25. In other words, the insurer would pay accident-related costs up to:

  • $30,000 for each injured person
  • $60,000 for all injured people
  • $25,000 for property damage

These amounts can vary by state. Be sure to check the requirements in your area to keep your business vehicles protected.
